Description
This Family Law covers both the "uncontested" and "contested" divorce, including initiating the divorce action with the Complaint, service of process, the Answer & Counterclaim, Interrogatories, Requests for Production of Documents, Notice to Produce, Third Party Discovery, & the Motion to Compel Discovery. The Child Custody section discusses initiating child custody actions, emergency hearings, custody modifications, and contempt actions. There is a discussion on using "Social Media" to win a contested child custody action in divorce or separate custody actions. The Motion for Judgment On The Pleadings discusses resolving an "uncontested" divorce without any parties having to appear in court to conclude the divorce action. As to "Legitimation" actions, this course discuses how parental rights may be obtained for children born out of wedlock. This course discuses "Temporary Hearings" used to obtain child support, child custody, alimony, Attorneys Fees, and other relief early in the contested divorce action. The section on "Contempt Actions" discuses procedures utilized when the opposing party violates the court order. This course also discuses "Settlement Agreements", "Mediation Agreements", the "Parenting Plan" and typical "Visitation" schedules. Additionally, there is a discussion on "Legal Separation", The "Complaint for Separate Maintenance", and being in a "Bonafide State of Separation". The section on "Paternity Tests" discusses the value of the test, as well as, actual case examples when husband in long-term marriages discovered that the children in the home were not his biological children and the subsequent actions that were brought in court. The discussion on "Income Deduction Orders" provides steps to take to prevent overpayment of child support. The discussion on "Child Abandonment Warrants" sheds light on the obligations of the father regardless of visitation. The discussion on "Domesticating A Foreign Decree" provides procedures to bring an action based on a court order from another state.
